Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case without complying the necessary formalities of law. There has been gross non-compliance of Section 41A of the Code of Criminal Procedure and surprisingly the petitioner has been detained by the Investigating Agency on and from 19th March, 2023. Mr. Mukherjee, learned Public Prosecutor, appears on behalf of the State and opposes the prayer for bail. Learned Public Prosecutor points out that the petitioner is involved in a fake job allotment racket. Learned Public Prosecutor also draws the attention of this Court regarding the communication being made to the concerned departments allegedly on and from whom appointment letters were issued.

I have considered the submissions of the petitioner as well as the learned Public Prosecutor. Having regard to the gravity of the offence at this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (SB) 74 of 2023 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
