The petitioner applied for seeking transfer on special ground in accordance with the provisions of Rule 4(1)(a) of the West Bengal School Service Commission (General Transfer, Transfer on Special Ground and Reallocation) Rules 2015.
The school authority on receipt of the application from the petitioner verified the same and issued the necessary 'No Objection Certificate' and forwarded the same to the District Inspector of Schools.
The District Inspector of Schools is yet to forward the same to the School Education Department as per provisions of Rule 7(2) of the aforesaid Rules. According to Rule 7(3), the School Education Department after proper examination, may recommend
the prayer to the West Bengal School Service Commission.
In view of the above, the instant writ petition is disposed of by directing the District Inspector of Schools (S.E.), Jhargram being the respondent No. 6 herein to take a decision with regard to the prayer of the petitioner which has been forwarded by the School to the office of the District Inspector of Schools and to verify the same in accordance with the above Rules. If the District Inspector of Schools is satisfied with the documents produced by the petitioner in support of her transfer on special grounds, then the District Inspector of Schools shall recommend the prayer of the petitioner to the West Bengal School Service Commission.
The District Inspector of Schools shall take a decision in the matter at the earliest, but positively within a period of six weeks from the date of communication of a copy of this order.
WPA 10192 of 2021 stands disposed of.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
