C.O. 1254 of 2022 KB Ct Sri Bharat Soni Vs Smt. Nandini Soni Mr. Mahendra Prasad Gupta, Mr. Shyamal Mondal, Mr. D.K. Saila Mr. Ayan Mitra, Ms. Antara Panja ....... For the petitioner. A direction to secure expeditious disposal of a Matrimonial Suit No. 52 of 2017 pending before the learned Principal Judge, Family Court No.2, Kolkata is the ultimate relief sought for in this case. It is submitted by the learned advocate for the petitioner that for the last two years, there is no regular presiding officer posted in respect of Family Court No.2, Kolkata, and the Principal Judge, is remaining in-charge of Family Court No.2, Kolkata. It is thus contended that in the absence of any regular presiding Judge being posted in respect of Family Court No.2, Kolkata, the petitioner/husband has been made to suffer serious prejudice, and as a result thereof there has been protraction caused to the trial of the instant case.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.

Service of notice of this application upon

opposite party stands dispensed with.

Accordingly, learned Judge remaining in-charge of Family Court No.2, Kolkata in connection with Matrimonial Suit No. 52 of 2017 is requested to ensure expeditious disposal of pending suit, referred hereinabove, subject to his convenience and suitability, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.

With this observation and direction, the revisional application stands disposed of.
