The petitioner is in custody for about 172 days and prays for bail. Learned counsel for the petitioner submits that the case is based on circumstantial evidence and besides the fact that the victim had a relationship with the petitioner and visited his house regularly, there is no other evidence implicating the petitioner in the alleged offence.

Learned counsel for the State opposes the prayer. It appears that the dead body of the victim was recovered from the swamp adjoining the petitioner's house. The victim was apparently in a relationship with the petitioner and visited his house regularly.

Considering the material available on record prima facie suggesting involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is disposed of.
