The petitioner claims to have completed the work. Reliance has been placed on the first and final bill, which is Annexure P/5 to the writ petition. It appears that the Junior Engineer, Jamuria Development Block had approved such bill and certified that an amount of Rs.2,80,158/- should be paid to the petitioner. The Executive Officer of the samiti also endorsed such bill and certification.

As the matter is now pending before the District Magistrate, Paschim Bardhaman, the said authority shall ensure that the payment should be made to the petitioner in accordance with law and in accordance with the certificate and the final bill, which has been annexed to the writ petition. If there are reasons to deny such payment apart from the paucity of fund, such reasons shall be disclosed in the order.

the funds are mobilized and the payment is released in favour of the petitioner.

This writ petition is disposed of with a direction upon the District Magistrate, Paschim Bardhaman to treat the writ petition as a representation and dispose of the same in accordance with law.

The petitioner and the Executive Officer or a representative of the Jamuria Panchayat Samity shall be heard. A reasoned order shall be passed and communicated to all.

The entire exercise shall be completed within a period of three months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
