Re: CAN 5 of 2024 This is an application at the behest of both the parties seeking to record compromise having entered in relation to the dispute involved in the instant appeal. A decree for dissolution of marriage was passed by the Trial Court, which is assailed by the wife in the instant appeal. By virtue of the compromise the wife/appellant intends to withdraw the instant appeal and all connected applications.

The terms incorporated in the compromise petition do not appear to us that the same is unlawful. The wife has further been given the permanent alimony. A Bank Draft covering the entire amount of permanent alimony bearing number 061720 dated March 14, 2024 drawn on Axis Bank is handed over to the wife/appellant in Court today.

The husband/respondent has agreed to execute a deed of gift in respect of Flat No. 309 situated on the 3rd floor of "Parbati Green Tower, Block-A" at Gopalpur Opposite of B.O.C. Asansol in favour of the wife/appellant and the minor daughter.

In such view of the matter, we do not find any impediment in recording the compromise arrived between the parties.

CAN 5 of 2024 is thus disposed of.

Accordingly, the instant appeal is treated to have been withdrawn on the terms and conditions as embodied in the instant application. Consequently the connected applications are also dismissed as withdrawn.

The decree need not be drawn up in the instant appeal.
