1. Petitioner in CRM (DB)/1551/2023 prays for cancellation of bail granted to the private opposite party on May 19, 2022 passed in CRM(DB) 1328 of 2022. Post bail misconduct is the ground canvassed for cancellation. In support of ground of post bail misconduct, reliance is placed on a complaint lodged to the police on February 21, 2023 by the petitioner.

2. Bail was granted on May 19, 2022. Two bail applications were lodged subsequently which were inquired into by the police and Kharagpur GRPS NCR no. 290 of 2023 dated March 9, 2023 and Kharagpur Town GDE no. 1377 dated February 21, 2023 NCR No. 138 of 2023 under Section 506 of the Indian Penal Code.

3. So called post bail misconduct is not so grave so as to cancel the bail granted by us.

4. In such circumstances, CRM (DB)/1551/2023 is dismissed without any order as to costs.

5. None appears for the petitioner in CRM (DB)/1528/2023.

6. State is represented.

7. In such circumstances, CRM (DB)/1528/2023 is dismissed for default.
