Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 3 months, charges have already been framed and the petitioner was intercepted by the Immigration Officer at the time she was entering India through the official work.

Learned advocate for the State opposes the prayer for bail.

Having considered that so far as accusations under the Foreigners Act are concerned, the same do prescribe term imprisonment and the supporting materials relating to the alleged offences under the BNS do require further confirmation, as such I am of the opinion that further detention of the present petitioner, who is a lady, is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Lucky Rudra @ Lucky Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Bongaon, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the District of 24 Parganas (North) without prior permission of the learned trial court.

Accordingly, CRM(M)1000 of 2026 is allowed.

Memo of Evidence submitted by the State be kept with the record.
