Learned counsel for the petitioner submits that the petitioner is in custody for more than 200 days. Charge sheet has been submitted. Witness action is yet to commence. The petitioner prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record. An 11 year old boy was mercilessly tortured by the petitioner who is the step father of the boy. The child has implicated the petitioner in his statement under Section 164 of the Code of Criminal Procedure.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
