The petitioners are the Ayurvedic Medicine practitioners. They are aggrieved as the Paschim Banga Ayurved Parishad in terms of the Paschim Banga Ayurvedic System of Medicine Act, 1961 is not in existence since its term expired on June 21, 2022. 3.

Learned advocate for the petitioners submits that the Ad hoc Committee is functioning at present. The petitioners pray for a direction upon the respondents for constitution of the statutory Parishad in terms of the Act.

Learned advocate representing the Registrar of the Parishad admits that after expiry of the term of the last Parishad, fresh election could not be held for constitution of the new Parishad.

It has been submitted that if order is passed by the Court then steps will be taken for conducting election for constitution of the Parishad.

Upon hearing the parties and on perusal of the Act, it appears that there is a requirement of the Parishad. The composition of the Parishad is specified in the Act.

The concerned authority is directed to take necessary steps for constitution of the Paschim Banga Ayurved Parishad strictly in accordance with law at the earliest, but positively within a period of twelve weeks from the date of communication of this order. 8.

The writ petition stands disposed of.
