For the Petitioner Mr. Madhusudan Sur,ld. APP Mr. Dipankar Pramanick, Advocates ... ...For the State Petitioner seeks bail.

Learned advocate appearing for the petitioner submits that the prosecution is failing to produce their witnesses at the trial.

State is represented.

The police case is of 2020. The Court is informed on behalf of the State that four prosecution witnesses were already examined.

Considering the fact that commercial quantity of narcotic was seized from the possession, we are of the view that the petitioner is unable to overcome the restriction under Section 37 of the NDPS Act, 1985.

Consequently, we are not inclined to grant bail to the petitioner.

However, we request the trial Judge to dispose of the trial as expeditiously as possibly and not to grant any unnecessary adjournments to any of the parties.

Prayer for bail of the petitioner is rejected. CRM (NDPS) 481 of 2022 is dismissed.
