Considering the urgency pleaded by the petitioner in CAN 5746 of 2020, the instant writ petition is taken up for hearing via video conference. Accordingly, the application being CAN 5746 of 2020 is disposed of.

The petitioner complains that the private respondents are disturbing and interfering in the process of attempting to repair her property. The said property was damaged during the recent Amphan Cyclone.

Counsel appearing on behalf of the petitioner submits that his client has lodged a complaint with the local police station and that the said disturbance is still carrying on.

Counsel for the State, Mr. Santanu Mitra along with Biswajit Dutta, submits that the Officer-incharge, Gobardhanpur Coastal Police Station,

Sunderland Police District, South 24 Parganas has taken due steps and has registered a case under Sections 107 and 116 of the Code of Criminal Procedure and that they are keeping strict vigil on the said premises. They further submit that the private respondents are not creating any disturbance any further.

The Officer-in-charge, Gobardhanpur Coastal Police Station, Sunderland Police District, South 24 Parganas is directed to ensure that the private respondents do not in any way disturb the petitioner in the process of reconstructing her damaged premises.

Counsel for the State submits that the police authorities have already warned the private respondents in this regard.

Let such vigil continuously be maintained by the police authorities to enable the petitioner to complete the construction of the damaged portion of her premises.

Let the instructions dated 4th September, 2020 submitted by the Officer-in-charge, Gobardhanpur Coastal Police Station, Sunderland Police District, South 24 Parganas filed by the Counsel for the State intimated to the Government Pleader be taken on record.

With the aforesaid directions, W.P.A. No. 6791 (W) of 2020 shall stand disposed of.

There will be no order as to costs.
