The petitioners being the accused in GR Case No. 2861/2017 have filed the instant criminal revision praying for quashing of the proceedings in connection with the above-mentioned case. The opposite party no. 2 is the de facto complainant and wife of the petitioner no. 1, since divorced.

GR Case No. 2861/2017 under Sections 498A/34 is pending before the Learned Judicial Magistrate at Amta in the district of Howrah.

During the pendency of the instant revision the parties have filed a joint application for compromise. On receipt of such application, it was sent to the concerned Police Station for enquiry and report. The Police Officer attached to Udaynarayanpur Police Station submits a report stating, inter alia, that the de facto complainant does not want to proceed with GR Case No. 2861/2017 under Section 498A/34 of the Indian Penal Code because of the fact that by way of mutual divorce, marital tie between the de facto complainant/opposite party no. 2 and the petitioner no. 1 has been dissolved. The opposite party no. 2 is not interested to continue with the above-noted criminal case only to drag the previous bitterness in her life.

In view of such circumstances and the police report the joint petition for compromise is accepted. GR Case No. 2861/2017 under Sections 498A/34 pending before the Court of the Learned Judicial Magistrate, Amta, Howrah be quashed in terms of the compromise. (Bibek Chaudhuri, J.) Srimanta, A.R.(Ct.)
