The petitioner complains that, the respondent no. 7 is not providing electric supply to the petitioner despite an application being made for such purpose.

Learned advocate appearing for the petitioner submits that, the private respondents although gave no objection to the petitioner receiving electric supply through a separate meter in the revisional application, however, are preventing the CESC authorities from providing electric supply.

Learned advocate appearing for the private respondents submits, on instruction, that the private respondents are not opposing grant of electric supply to the petitioner. However, the private respondents also applied for

electric supply, which the CESC Authorities should consider. The representative of CESC Authorities submits that, the CESC Authorities do not object to electric supply being given to any of the parties. However, the CESC Authorities are not given access to the place where the supply is to be effected.

The petitioner being in settled position is entitled to electric supply. The CESC Authorities will take appropriate measures for the purpose of effecting electric supply to the petitioner. In the event, the CESC Authorities find any obstruction in executing this order, they are at liberty to approach the appropriate police authorities for police assistance. In the event, the CESC Authorities approach the police authorities for police assistance, no doubt, the police authorities will render adequate police protection to the CESC Authorities to implement this order.

It is expected that the CESC Authorities effect electric supply to the petitioner within seven days from date subject to the petitioner paying all costs, charges and expenses thereof. Needless to say that, the petitioner will comply with all the formalities for the new electric supply. This order will not prevent the CESC Authorities

from considering the application of the private respondents for separate electric supply, in accordance with law. It is clarified that this order will not create any new right, title, interest or equity in favour of the petitioner. WPA 10234 of 2021 is disposed of accordingly without any order as to costs.
