Report dated 28.09.2022 submitted by Officer-inCharge, Khardah Police Station be kept on record. The said report reflects that the petitioner has acted in accordance with the order passed by this Court on 22.09.2022 and has tendered apology to the de facto complainant/opposite party no.2. A statement of the opposite party no.2 has been recorded by the Officer-in-Charge, Khardah Police Station and enclosed along with the said report which reflects that the opposite party no.2 has no grievance against the petitioner.

Having regard to the nature of the offence, I am of the opinion that for greater interest of justice, further continuance of the proceedings is unwarranted. Accordingly, all further proceedings of Khardah Police Station Case No. dated 18.03.2019 under Sections 323/325/341/379/506/509 of the Indian Penal Code and

the charge-sheet filed therein under Sections 341/323/506 of the Indian Penal Code pending before the learned Additional Chief Judicial Magistrate, Barrackpore, North 24-Parganas are hereby quashed.

The revisional application being CRR 1253 of 2021 is, thus, allowed.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
