The petitioner retired from service of the Durgapur Projects Limited on 31st July, 2023. His allegation is that his terminal dues, including gratuity and leave encashment, have not been disbursed in his favour despite the same being sanctioned on 6th March, 2026.

Prayer has been made to direct the respondents to release the terminal dues along with interest on account of delayed payment.

Upon hearing the submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that the petitioner, though retired in the year 2023 but has not received terminal dues till date. The dues were sanctioned after nearly three years of his retirement.

The terminal dues ought to have been released immediately on retirement or soon thereafter. The authority ought not to have delayed for three years for disbursal of the terminal dues of the retired employee.

In view of the above, the respondent nos.2 and 4 are directed to take prompt necessary steps to disburse the gratuity and leave salary in favour of the petitioner positively within a period of eight weeks from the date of communication of this order.

As the petitioner will receive his legal terminal dues after considerable delay, the gratuity and leave encashment shall be paid along with simple interest calculated at the rate of six percent per annum payable on and from the next date of retirement till the date of actual payment.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
