1. The petitioner was unsuccessful in the recruitment process of the year 2009. He challenged the same before a Single Bench of this Court. The said writ petition was dismissed on 6th December, 2021 in WPA 18672 of 2021. The petitioner challenged the same in appeal which was disposed of by a Division Bench of this Court on 10th November, 2022 along with WPA 29606 of 2014 (Jhum Jhum Halder & Ors. Vs. The State of West Bengal & Ors.).

2. It appears from the representation of the petitioner at Annexure P/9 dated 24th February, 2020 that admittedly he was unsuccessful in the year 2009 but required the respondents to consider his candidature under the Rules of 2006. It appears that the petitioner has been continuously approbating and reprobating

this Court since he has already approached this Court earlier with WP 22957 (W) of 2005 where the respondents were directed to consider his Bio-data for the year 2006. The writ petitioner has never challenged his alleged non-consideration in the recruitment process of the year 2006.

3. The question of any relief to the petitioner in these facts and circumstances does not and cannot arise.

4. The writ petition fails and hereby dismissed.

5. There will be no order as to costs.

6. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
