Learned advocate for the petitioners approached this Court as there was interference with the peaceful enjoyment of the property. Petitioners complain that there were obstructions, blockade and disturbance created in the free egress and ingress to the residential accommodation of the petitioners and in spite of informing the police authorities, no steps were taken.

Learned advocate for the State submits that at the relevant point of time on receipt of the information, police authorities registered Baruipur P.S. Case No.587 of 2024 dated 19.04.2024 against the respondent nos.5 to 8.

Petitioners have submitted a supplementary affidavit. By way of such supplementary affidavit,

petitioners expressed their grievance with respect to act and action particularly with regard to noncollection of relevant materials in connection with the case.

Petitioners would approach the jurisdictional Magistrate in case the investigation is complete. In the alternative, if the investigation is still pending, petitioners will submit the relevant materials to the investigating officer of the case. If there are materials in custody and an application for further investigation is filed at the behest of the petitioners, learned Magistrate would assess regarding the requirement of the materials which are in custody of the petitioners and accordingly pass necessary directions as he deems fit and proper.

With the aforesaid observations, WPA 9956 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
