Mr. Sanjib Seth ...for the Petitioner Mr. Sandipan Banerjee, Mr. Ankit Sureka ...for HMC Mr. Sougata Mitra, Ms. Nabanita Kapat ...for the State 17-12-2024 AKG Ct. 15 The petitioner seeks a compassionate appointment under the Howrah Municipal Corporation following the death of his mother, who was employed as a 'Peon' by the Corporation.

The learned advocate for the Howrah Municipal Corporation submits that there is no existing scheme within the Corporation for compassionate appointments. Similarly, the learned advocate for the petitioner was unable to produce any applicable scheme that provides for compassionate appointments for employees who have died in harness.

Accordingly, in light of the Supreme Court's judgment passed in SLP (C) No. 012166-012179 of 2020 (The State of West Bengal vs. Sri Debabrata Tiwari & Ors.), I am not inclined to entertain this writ petition. In the absence of an applicable scheme or

policy, compassionate appointments cannot be granted by local authorities in the State.

Accordingly, WPA 9939 of 2024 is dismissed.
