Mr. Islam, learned advocate appears on behalf of the petitioner and challenges the proceedings arising out Baxirhat Police Station Case No. 139 of 2017 dated 26.08.2017 under Sections 341/323/325/354A/506/34 of the Indian Penal Code pending before the learned Additional Chief Judicial Magistrate, Tufanganj, Coochbehar.
As none appears on behalf of the State, Mr. Arijit Ganguly, who ordinarily appears on behalf of the State is directed to appear in this matter to represent the State. His appointment may be regularized by the concerned authorities in due course. I have perused the enclosures of the revisional application and I find that the petitioner approached before this court at a stage when the investigation of the case was under progress. It has been submitted that subsequently chargesheet has also been
submitted in connection with the instant case. Having regard to the changed circumstances, I am of the view that the present revisional application has lost its force. However, the petitioner would be at liberty to agitate the points canvassed in the revisional application at the appropriate stage of the proceedings before the learned trial court. With the aforesaid observations, the revisional application being CRR 1339 of 2018 is disposed of.
All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
In view of the proceedings being registered for investigation in the year 2017 and the mental agony involved both by the de facto complainant as well as the accused persons, I direct that the learned trial court would take steps for concluding the trial within a reasonable period of time.
