Petitioner has made a prayer for transfer from one primary school to another primary school in the district of South 24 Parganas. However, petitioner was appointed as a primary teacher on and from 18th February, 2021. Therefore, petitioner has not completed five years of continuous service being a confirmed teacher.

It has specifically been provided in the amended Rule 2 as contained in the notification dated 13th September, 2021 whereby Rule 4(b) of West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002 was amended that the teacher needs to complete minimum five years of continuous service in case of single transfer. In the present case since petitioner has not completed five years of continuous service, no relief

can be granted.

The writ petition stands dismissed.
