Learned advocate for the petitioner submits that the petitioner is working in the army and on a single incident of dispute the wife committed suicide and as such after eight years of marriage the petitioner has been implicated in connection with this case. Learned advocate for the State opposes the prayer for anticipatory bail and submits that there are materials appearing against the present petitioner. However, on query the learned advocate for the State concedes that this was a single incident which was the foundation of the society.
Having regard to the submission advanced by
both the parties and on perusal of the materials on record, we are of the opinion that for the investigation of the case the custodial detention of the petitioner may not be warranted.
Accordingly, we allow the prayer for anticipatory bail.
In the event of arrest, the petitioner shall be released on bail upon furnishing bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of like amount, to the satisfaction of the arresting officer of the case.
The aforesaid order shall be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The application for anticipatory bail being C.R.M. 6200 of 2020 and C.R.A.N. 4708 of 2020 are disposed of.
