19.04.2023 sdas rejected C.R.M. (NDPS) No. 798 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NCB Crime No. 69/WCB/KOL/2021 dated 19.08.2021 under Sections 8(c )/22(c )/29 of the NDPS Act.

And In Re : Rosid Mia ..... petitioner Mr. Sovan Dasgupta ... for the petitioner Mr. Sanjoy Bardhan Mr. Chittranjan Ghosh ... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Petitioner was the driver of the vehicle which was used to carry narcotics above commercial quantity.

In view of the aforesaid circumstances and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
