C.R.R. 1345 of 2018 Sri Biswajit Samanta versus Smt. Arati Samanta In Re: An Application under Sections 397/401 of the Code of Criminal Procedure, 1973.

The present revisional application has been preferred against the judgement and order dated 10.05.2018 passed by learned Judicial Magistrate, 1st Court, Contai, Purba Medinipur in connection with Misc. Case No. 81 of 2016. I find that the learned Magistrate was pleased to award a sum of Rs.8000/- per month as maintenance. The very foundation of the award which has been fixed by the learned Magistrate is relating to the qualification of the husband/petitioner who happens to be a B.Tech Electrical Engineer working at Muscat, Oman.

In view of the reasoned order passed by the learned trial court after considering the evidence, which has surfaced in course of the trial proceedings, I do not find any illegality in the order so passed by the learned Magistrate and as such, I am of the opinion that no interference is called for. Accordingly, the revisional application being CRR 1345 of 2018 is dismissed.

All pending connected applications, if any, are consequently disposed of.
