IN THE HIGH COURT AT CALCUTTA

Item No.41 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 1352 of 2018 Sahajahan Ali versus The State of West Bengal & Ors.

In Re: An Application under Section 482 of the Code of Criminal Procedure.

Mr. Arijit Ganguly, Ms. Sujata Das ... For the State.

None appears for the petitioner or for the State. As such, Mr. Arijit Ganguly, learned advocate, who ordinarily appears for the State, is directed to appear in this matter and represent the State. His appointment may be regularized by the concerned authorities.

The present revisional application has been preferred challenging the charge-sheet filed in connection with Jalangi Police Station Case No. 647 of 2011 dated 29.07.2011. I find from the documents enclosed along with this revisional application that only the report under Section 173 of the Code of Criminal Procedure has been enclosed. It reflects from the records that charge-sheet was submitted in the year 2012 under Sections 325/307/34 of the Indian Penal Code. More than 10 years have passed since the charge-sheet was filed and the case was already committed to the court of sessions and was in the process of trial. On an appreciation of the contentions advanced in this revisional application and the documents available therewith

only the charge-sheet, I am of the opinion that prayers as advanced by the petitioner cannot be adjudicated at this stage.

Accordingly, the revisional application being CRR 1352 of 2018 is dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
