Case No. 77/20 dated 15.01.2020 under Sections 498A/307/34 of the Indian Penal Code and adding Section 302 of the Indian Penal Code.

In the matter of : Abdur Rahim @ Abdul Rahim ..... petitioner Mr. Somnath Adhikary ....For the petitioner Mr. Neguive Ahmed Ms. Amita Gaur .....For the State The petitioner undertakes to affirm and stamp the petition as per Rules within one week of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that another person similarly situated as the petitioner has been granted bail by the lower court. The State opposes the prayer on the basis of the dying declaration of the victim.

The petitioner, as the husband of the deceased, was clearly named as one of the persons who had set the victim on fire. Considering such material against the petitioner, the prayer for bail is rejected.

CRM 6212 of 2020 and the interim application therein are disposed of.
