No. 6214 of 2020 Hafizul Sk @ Hafijul Sk -vsThe State of West Bengal with CRAN/1/2020( Old No.4725/ 2020 In Re: An application for bail under Section 439 CrPC in connection with Jalangi P.S. Case No.896 of 2015 dated 22.8.2015 under section 22 of the NDPS Act.

Mr. Somnath Adhikary ...for the petitioner Mr. Ranabir Roy Choudhury ... for the State The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within one month of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking. The learned Advocate appearing for the petitioner submits that the petitioner is in custody since 22.8.2015. As there has been no progress in the trial for a considerable period of time, the learned Advocate prays that the petitioner may be released on bail. The learned Advocate appearing for the State opposes the prayer for bail and produces the memo of evidence from which it is reflected that 946 bottles of phensedyl were recovered from the possession of the petitioner. It has also been found from the records of the case that lastly the bail application of the petitioner was rejected on 2nd March, 2020 in CRM 2240 of 2020. We do not find any change of circumstances since the last date of rejection of bail of the petitioner.

Accordingly, the present application for bail is rejected.

CRM No.6214 of 2020 and CRAN/1/2020(Old No.4725/ 2020 are disposed of.
