Case No. 120 of 2018).

... for the State Mr. Madhusudan Sur, Learned Additional Public Prosecutor appearing for the State opposes the prayer for bail and produces the Case Diary and submits that the notice for warrant of arrest has already been issued against the petitioner. In spite of that the petitioner did not surrender before the Learned Court below.

That being the scenario, we are of the considered view that the present application for anticipatory bail should be rejected thereby directing the petitioner to take step on the basis of the notice of warrant of arrest already issued. Accordingly, the present application for anticipatory bail is rejected.
