Mr. Dipankar Aditya ...for the petitioners Mr. Prasun Kr. Dutta, Mr. Nirupam Dhali ... for the State The advocate-on-record for the petitioners undertakes to affirm and properly stamp the petition as per the rules within one month of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking.
The learned Advocate appearing for the petitioners submits that the petitioners have been falsely implicated in the case and as the charge-sheet has already submitted, the detention of the petitioners are unwarranted.
The learned Advocate appearing for the State produces the case diary and draws the attention of this court to the statement of the victim girl.
On perusal of the statement of the victim girl, we find that the present petitioners are thickly connected with the offence and it would not be safe to release them at this stage before the evidence of the victim girl is recorded in the Trial Court. In view of the aforesaid, the application for bail is rejected.
