Siddiqui ... ... for the State Learned counsel for the State submits that the writ petition may be premature since the petitioner has alternative remedy to approach the Range Deputy Inspector General of Registration, Calcutta with a representation of incorrect assessment of stamp duty.
In that view of the matter, the writ petitioner may make a fresh representation to the Range Deputy Inspector General of Registration, Calcutta within a period of 15 days from date as regards his allegation of improper valuation of his title. Upon receipt of the petitioner's representation, the Range Deputy Inspector General of Registration, Calcutta shall consider the same and dispose of by a reasoned order within a period of two months thereof.
Learned counsel for the petitioner submits that in terms of the order dated 30th June, 2021, he has already registered his document by putting in the stamp duty which has been notified by the Collectorate.
Needless to mention that in the event the Range Deputy Inspector General of Registration, Calcutta finds that there has
been over valuation or any excess amount paid by the petitioner, the same may be refunded to him expeditiously. With the aforesaid observations, the writ petition is disposed of.
Since no affidavits have been called, the allegations in the writ application shall not be deemed to have been admitted by any of the respondents.
There will be no order as to costs.
