Report filed on behalf of the State is also taken on record. A copy of the report be handed over to the learned counsel for the petitioner.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a post holder of the Indian National Congress Party. He had been the Sabhadhipati of Murshidabad Zilla Parishad earlier. Over the years the police administration in league with the ruling political dispensation had been unnecessarily harassing the petitioner to deter him from undertaking further political activities. During the last few polls he had been unnecessary called to the police station and often detained. Several false cases were instituted against him in this regard. He either obtained bail in this or was acquitted. He apprehends that similar illegal activities would be committed this time.

Learned counsel appearing on behalf of the State relies on the report and submits as follows. There is a list of cases given in the report, which were started against the petitioner. As of now, no further criminal case has been instituted against the

petitioner at the Berhampur police station. It is denied that the police authorities had been unnecessarily harassing the petitioner or would be doing so in future.

It does not appear that at present the petitioner is aggrieved with any particular overt act or illegality of the respondent police authoritis.

However, there is an apprehension in the mind of the petitioner.

On the basis of such apprehension this Court cannot pass any order. However, the police authorities shall only act in accordance with law.

No further order need be passed in this regard. With these observations the writ petition is disposed of. Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon competition of requisite formalities.
