WPA 9343 of 2025 (Jahanara Bibi vs. State of West Bengal & Ors.) G. F. Hossain Ms. Varsha Roy .... For the Petitioner Affidavit of service filed on behalf of the petitioner is taken on record.

The Panchayat and the private respondents are not represented despite service.

Learned counsel for the petitioner submits that the petitioner and the private respondents are co-owners in respect of the plot in question. The private respondents are raising construction therein without obtaining sanction from the concerned Panchayat.

The petitioner sent a representation before the concerned authority on 6th February, 2025 which returned to her with an endorsement 'refused'.

The petitioner seeks consideration of the representation submitted by her.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the representation sent by the petitioner to the Pradhan, Nainan Gram Panchayat, being the 7th respondent herein, was not received by the latter, the 7th respondent is directed to consider and dispose of the said representation within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law.

A copy of the application along with a copy of this order be served upon the 7th respondent by the petitioner at the earliest.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
