For the Petitioners Learned Advocate for the petitioners submits that the petitioners have been falsely implicated in connection with Complaint Case No. 13318 of 2022 under Section 25(1), 25 and 27 of the Payment and Settlement Systems Act, 2007 read with Section 138 of the N.I. Act, which is pending before the Learned Metropolitan Magistrate, 4th Court, Calcutta.
Learned Advocate submits that warrant of arrest has been issued against the petitioners.
The Learned Trial Court is directed that since the substantial offences complained of are bailable, if the petitioners appear or surrender by 30th of September, 2023 before the Learned Trial Court, the petitioners shall be released on bail upon furnishing the bond as the Learned Trial Court deems fit and proper.
So far as the other issues are concerned, the same relates to the question of facts.
However, the petitioners would be at liberty to canvass such points in course of the trial of the case. With the aforesaid observations, CRR 1662 of 2022 is disposed of.
