No. 29 KAUSHIK REJECTED C.R.M.(A) 1652 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Dankuni Police Station Case No. 60 of 2023 dated 28.02.2023 under Sections 341/323/325/326/307/333/504/506/34 of the Indian Penal Code, 1860.

And In Re : Sk. Jamal @ Sk. Jamaluddin ...... petitioner Ms. Disha Shukla Mr. M. Obaid ....for the petitioner Ms. Zareen N. Khan Mr. Arup Sarkar ....for the State An incident of assault took place in which, an injured suffered injuries resulting in his hospitalisation as well as removal of his spleen due to injury suffered. A village police was also assaulted.

Petitioner stands implicated in the incident of assault. In such circumstances, considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1652 of 2023 is dismissed.
