Kausik (Allowed) CRM (NDPS) 820 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1476 of 2024 dated 17.09.2024 under Sections 21(C)/25/27A/29 of the NDPS Act.

Learned advocate for the petitioner submits that the principle on which another accused has been granted bail in CRM (NDPS) 506 of 2026 be extended to the present petitioner. Learned advocate for the State opposes the prayer for bail and submits the Memorandum of Evidence.

Mr. Sagar Saha, learned advocate empanelled with the Union of India is directed to represent the State. His appearance may be regularized by the concerned authorities. Petitioner is in custody for 1 year and 8 months and only 2 witnesses till date has been examined out of 13 witnesses cited in the charge sheet.

Having considered that other accused persons have been granted bail in CRM (NDPS) 350 of 2026 and CRM (NDPS) 506 of 2026 on the same principle, I am inclined to release the petitioner on bail.

Petitioner be released on the same terms and conditions as was imposed upon the accused in CRM (NDPS) 506 of 2026. Accordingly, CRM (NDPS) 820 of 2026 is allowed. Memo of Evidence filed be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
