Mr. Arijit Ganguly Mr. Sandip Chakraborty ...for the State The revisional application has been preferred challenging the order dated 2.2.2011 passed by the Learned Additional District & Sessions Judge, Fast track 1st Court, Howrah arising out of Bally Police Station case no. 74 of 2006 dated 13.3.2006. The order dated 2.2.2011 reflects that the learned trial court after considering the materials appearing in the case records was pleased to opine that charge under Section 413 of the Indian Penal Code is sustainable and thereafter dismissed the application so filed by the present petitioner. Having regard to the reasons so assigned by the learned trial court and the fact that no interim order was passed restraining the proceedings when the revisional application was taken up for consideration on 21.9.

2011 by a coordinate bench of this Court, I am of the view that no interference is called for. None appears on behalf of the petitioner or for the State, as such Mr. Arijit Ganguly who ordinarily appears on behalf of the State, was directed to appear for rendering his assistance. His appointment may be regularised by the concerned authorities.

In view of the observations made above, the revisional application being CRR 1421 of 2011 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
