IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1427 of 2011 Mamoni Dutta

Versus

State of West Bengal & Anr.

In Re: An application under Section 401 of the Code of Criminal Procedure, 1973 Mr. Arijit Ganguly Mr. Sandip Chakraborty ... for the State The present revisional application was preferred against the order dated 07.04.2011 passed by the learned Sessions Judge, Paschim Medinipur, wherein the learned Sessions Judge was pleased to allow the prayer for bail of the accused/opposite party in connection with the Mohanpur Police Station Case No. 65/10 dated 07.11.2010 under Section 498A/376/34 of the Indian Penal Code. The present application has been preferred in the nature of cancellation of bail by way of importing revisional jurisdiction of this Court. According to the learned Sessions Judge unnecessarily the accused was detained in custody

and no efforts were taken by the learned Magistrate for commitment of the case.

Reason being assigned by the learned Sessions Judge and the fact that the order of bail was granted on 07.04.2011, i.e., more than ten years and there is no information furnished to the Court regarding post bail conduct of the accused, I am of the view that no interference is called for in respect of the order so passed by the learned Sessions Judge.

Accordingly, CRR 1427 of 2011 is dismissed.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
