Galib Ms. Subhra Nag .....for the State The grievance of the petitioner appears to be nonconsideration of a representation dated 9th May, 2021 by the SDO, Medinipur Sadar, Paschim Medinipur. The undisputed case is that the original caste certificate of the petitioner was impounded by the authorities and an enquiry is presently going on. However, since it is submitted on behalf of the State that the enquiry is continuing since 2020, the SDO has no business to keep the enquiry pending for more than two years and holding on to the original caste certificate of the petitioner.

The SDO shall hence complete the enquiry within two weeks from today. There is also no defence as to why the SDO did not respond to the representation of May, 2021.

WPA 8823 of 2022 is accordingly disposed of with the direction on the SDO, Medinipur Sadar, Paschim Medinipur, being the respondent No. 6, to complete the

enquiry and pass a reasoned order thereon within a period of two weeks from date. A copy of the order shall be made available to the petitioner within three weeks from today. Needless to say, the petitioner shall be heard in the process. The statutory requirement of giving 15 days' notice to the petitioner is waived. The fact of both the parties being before the Court shall be deemed as notice to the petitioner.
