Petitioner is aggrieved by the fact that in spite of informing the Inspector-in-Charge, Farakka Police Station, no steps have been taken. According to the petitioner, the other family members are interfering and trying to grab the property of the petitioner and also attempting to throw her away from the property. Further the petitioner and other family members are also subjected to assault and their life has been made miserable because of the continuous physical and mental torture being inflicted.

State has submitted a report. Report reflects that on receipt of the information, the Inspector-inCharge, Farakka Police Station have taken steps by

drawing up proceedings under Section 126 of the BNSS.

Having considered that there is a family feud which is difficult for the police authorities to directly interfere, if the petitioner is aggrieved, petitioner will approach the learned jurisdictional Magistrate and in case directions are passed, the police authorities would be empowered to take action pursuant to the directions of the learned Magistrate.

In the alternative, police authorities as they have been keeping vigil, they would continue the surveillance and ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations, WPA 9268 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
