The petitioner is in custody for 6 years and prays for bail. The petitioner submits that he has been falsely implicated and there is no material against him in the statement of the victim girl recorded under Section 164 of the Code.

The State opposes the prayer for bail and refers to the case diary including the statement of the victim girl recorded under Section 164 of the Code and medical reports of the victim.

We have considered the material in the case diary. Though it is true that the petitioner is in custody for more than 6 years, having considered the prima facie material against the petitioner in the case diary and the nature and

gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

However, we request the learned Trial Court to conclude the trial as soon as the business of the Court may permit without granting unnecessary adjournments to the parties.
