The revisional application was preferred challenging the proceedings pending before the learned Metropolitan Magistrate, 10th Court, Calcutta under Section 211(7) of the Companies Act, 1956 and all orders passed therein.

Records of this revisional application reflects that there was an interim order for a period of six weeks passed by a coordinate Bench of this Court by its order dated 10.04.2017. Subsequently, the compliance which were required to be furnished before this court are not on record as also the fact that the present position of the case before the learned trial court has not been placed.

I have perused the petition of complaint and the allegations made therein and I am of the opinion that the same prima facie makes out a case for continuance of the trial. Accordingly, no interference is called for.

Thus, CRR 1131 of 2017 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
