The application for anticipatory bail has been initiated by the petitioner/husband wherein the offence alleged is under Sections 85/117(2)/109/3(5) of the BNS.

It appears that there is an allegation under Section 109 of the BNS.

It is submitted by the learned counsel for the de facto complainant and the petitioner that an attempt to amicably settle the matter has failed.

Learned counsel for the State has placed the case diary. It appears from the case diary and the injury report that the injuries, prima facie, are simple in nature. Accordingly, in the event of arrest, the petitioner shall be released on bail of Rs.5,000/- with two sureties of Rs.2,500/- each to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further condition that the petitioner shall cooperate with investigation and shall meet the investigating officer as and when required.

The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
