The petitioner complains of illegal and unauthorized construction at the instance of the respondent nos. 6 & 7.
In response to the complaint lodged by the petitioner, Serampore Municipality issued notice under Section 218 of the West Bengal Municipal Act, 1993. The grievance of the petitioner is that no consequential step was taken thereafter for demolition of the unauthorized construction.
Learned advocate representing the Municipality submits, upon instruction that, necessary consequential steps shall be taken in the matter in accordance with law.
In view of the above, the instant writ petition is disposed of by directing the Board of Councillors, Serampore Municipality to take steps in accordance with law, to deal with the unauthorized construction after giving proper notice to the person responsible for making construction.
Endeavour shall be taken to ensure that the unauthorized construction is demolished within a period of twelve weeks from the date of communication of a copy of this order.
Affidavit-of-service filed in Court today is taken on record.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
