The father of the petitioner who was working as a Panchayat Karmee under Pindra Gram Panchayat, PuruliaII Development Block, died-in-harness. The petitioner filed an application for compassionate appointment in the prescribed form. The proposal for appointment of the petitioner was prepared and the name of the petitioner was placed at serial No.708.

Undoubtedly, such appointment must be given in accordance with the vacancies available for appointment under the died-in-harness category and as per the serial number of the candidate.

The writ petition is disposed of with a direction upon the Joint Secretary to the Government of West Bengal, Department of Panchayat and Rural Development

to intimate the petitioner about the fate of the recommendation made by the Commissioner, Panchayats and Rural Development, West Bengal, dated May 17, 2012. The authority shall pass a reasoned order disclosing the serial number of the last person appointed, whether any person who was listed below the petitioner had been given any appointment or whether the petitioner was within the zone of consideration. The intimation shall reach the petitioner within three months from the date of communication of this order.

A copy of the writ petition along with a server copy of this order be served upon the Joint Secretary to the Government of West Bengal, Department of Panchayat and Rural Development.

This Court has not expressed any opinion on the merits of the claim of the petitioner.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
