The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within forty eight hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.
This is a case of 2013. The accusation against the petitioner is, inter alia, under Section 376 of the Indian Penal Code and Sections 3(a)/4 of the Prevention of Children from Sexual Offences Act.
The petitioner was granted bail on 22nd October, 2013. The bail was cancelled and he was rearrested on 13th November, 2019, as he failed to appear before the learned Court below. Charge-sheet has been submitted, but charge has not been framed.
Considering all the circumstances it would not be prudent to enlarge the petitioner on bail, but to expedite the trial. We direct the learned Court below to frame the charge as expeditiously as possible and to conduct and conclude the trial by 30th June, 2021.
CRM 6284 of 2020 and the interim application filed therein are disposed of.
