Learned advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused person namely, Basudeb Ghosh who has been granted bail in CRM (NDPS) 1000 of 2025. Petitioner is in custody for almost three months and as the prosecution has relied upon 14 witnesses in order to prove its case, learned advocate prays for bail as the trial would consume substantial time.
Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that petitioner is not similarly situated as Basudeb Ghosh, the other accused who has been granted bail.
Having regard to the aforesaid, the prayer for bail of the petitioner is allowed.
As such, petitioner namely, Saddam Mondal @ Chhadam Mondal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act cum ADJ, 3rd Court, Dakshin Dinajpur at Balurghat. If on bail, the petitioner shall be physically present on each and every date fixed by the learned Special Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) No. 789 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
