Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than ten months. Earlier prayer for bail of the petitioner was refused in CRM (NDPS) 142 of 2026 wherein there was a direction to split up the trial of the case within sixty days and the Trial Court was directed to proceed with the stage of consideration of charges.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.
Records of the case reflect that there has been alleged recovery of 415 grams of brown sugar. The chemical examiner's report reflects that the seized quantity contains Diacetylmorphine (Heroin), 6-Monoacetylmorphine and Acetylcodeine. Having considered the period of detention of the present petitioner and the fact that there has been no
quantification in the chemical examiner's report, I am of the view that the judgement of the Hon'ble Supreme Court in Sentu Seikh Vs. State of West Bengal arising out of SLP (Crl.) No. 13987/2025 is applicable to the present case as similarly placed accused persons have been released on bail. However, since the Trial Court has been proceeding for arriving at the stage of consideration of charges and such date is fixed on 11.05.2026, I direct the learned Trial Court to release the petitioner viz., Hazra Begam on bail on such terms and conditions as it deems fit and proper after the stage of consideration of charges is over. If for any other reason, the learned Trial Court is unable to frame the charges on 11.05.2026, then within a period of fortnight from the said date, learned Trial Court would put in efforts to complete the same.
With the aforesaid observations, the application for bail, being CRM (NDPS) 791 of 2026, is disposed of. Learned advocate appearing for the State is directed to communicate this order to the learned Trial Court. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
