Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than four and half months. Earlier he was granted bail, thereafter petitioner did not appear before the learned Special Court and as such, by exhausting the harsher process of law he was taken into custody. Learned advocate appearing for the State opposes the prayer for bail and submits that petitioner has misused the liberty granted to him. The subject matter of the case relate to alleged recovery of 50 bottles of phensedyl.
Petitioner's complicity relates to be implicated in the instant case on the basis of statement of the co-accused. Having regard to the same, I am inclined to release the petitioner on bail on stringent conditions. Accordingly, the prayer for bail of the petitioner is allowed.
As such, the petitioner, namely, Mintu Sk @ Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), Berhampore, Murshidabad.
If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall once in a week till further order of this Court meet with the Officer-in-Charge or any police personnel deputed by the Officer-in-Charge of Domkal Police Station.
Learned trial Court would once in a month check regarding the attendance of the present petitioner and in case, there is violation of the aforesaid conditions learned trial Court would cancel the bail of the petitioner without further reference of this Court. Accordingly, CRM (NDPS) No. 792 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
