A direction to secure expeditious disposal of interlocutory applications, like application under Sections 7(1) and 7(2) of West Bengal Premises Tenancy Act, read with Section 5 of the Limitation Act, and a separate application under Section 10 of the Code of Civil Procedure, is the ultimate relief sought for in this case.
No other point is raised requiring address by this Court.
The only contention expressed by the learned advocate for the petitioner is that the suit is getting delayed for the pendency of the interlocutory applications, referred hereinabove.
In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite parties.
Service of notice of this application upon opposite parties stands dispensed with.
Accordingly, the learned Civil Judge (Senior Division), 8th Court, Alipore in Title Suit No. 650 of 2018 is requested to ensure expeditious disposal of
interlocutory applications referred hereinabove, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.
While endeavouring such exercise the interlocutory applications under Sections 7(1) and 7(2) read with Section 5 of the Limitation Act may be disposed of first, and then application under Section 10 of the Code of Civil Procedure may be disposed of thereafter, but all such applications may be disposed of preferably within 31st December, 2022.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.
With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
