No. 29 KAUSHIK REJECTED C.R.M.(A) 1654 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Burtolla Police Station Case No. 254 of 2022 dated 06.12.2022 under Section 401(A) of the Kolkata Municipal Corporation Act, 1980.

And In Re : Anare Lal Gupta ...... petitioner Mr. Debabrata Acharyya Mr. Sital Samanta ....for the petitioner Mr. Bidyut Kumar Roy Ms. Sima Biswas ....for the State The police complaint is with regard to an unauthorised construction.

Kolkata Municipal Corporation (KMC) Authorities invoked provisions of Section 401 of the KMC Act, 1980 as against the petitioner.

Materials in the case diary suggest requirement of immediate custodial interrogation of the petitioner. In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1654 of 2023 is dismissed.
